Title: Writer's Digest Publication rights granted from award winners?
Post by: Anthony-Baldasare on March 16, 2021, 07:26 PM
I felt this deserved a separate topic.  while reading terms of agreement for the Writer's Digest self-published awards, one clause stipulates that contestant winners grant sponsor publication rights to the winning entries.  -to be published in any WD publication.  -wouldn't something like this violate KDP's rules?  It also mentions publishing the winning entries in digital form.  I know WD is a reputable company but isn't this a huge red flag?

Sorry: Is this the regular program you are asking about or KDP Select?

Hi David.  I am currently using KDP select, which requires exclusivity.  But perhaps I'm unclear about some of the details regarding Amazon's policies.  I know I'm able to sell printed versions of my book elsewhere, but are you implying that with 'standard' KDP, the book (and/or ebook) can be sold elsewhere?  obviously I own the copyright, but for some reason I have the mindset that since Amazon 'publishes' the book, it's  publication elsewhere somehow violates their polices.  Writer's Digest claims it would have the nonexclusive right to reproduce, display, promote and distribute winning entries in digital form, including but not limited to websites,  databases, or part of downloadable products associated with their competitions.

You should ask the lawyer, Anthony, but I'm pretty sure Select would preclude your work from being published anywhere else.

This is my metaphor: You own a house. You can do anything you want. Then you rent it on AirBnB(KDP Select) for a month. Sure, you'll make money, but what you can do with your house for that month is extremely limited.
